Massachusetts Question 3 Explained

This past Tuesday, voters in the state of Massachusetts passed a measure known as “Question 3” by a count of 1,808,947 (63%) in favor. This measure calls for decriminalization of marijuana for select medicinal purposes. The initiative on the ballot appeared as:

“A YES VOTE would enact the proposed law eliminating state criminal and civil penalties related to the medical use of marijuana, allowing patients meeting certain conditions to obtain marijuana produced and distributed by new state-regulated centers or, in specific hardship cases, to grow marijuana for their own use.”

Fan. Fucking. Tastic! Just another state coming to its senses regarding marijuana policy. This law will allow patients suffering from certain medical disorders to legally obtain marijuana from dispensaries or grow their own. However, there are still many questions to be addressed. What conditions are eligible for this treatment option? How much can one patient carry/grow? How will this law be regulated?

For one, this law applies only to patients with certain approved diseases/disorders. So far, the state has not specified exactly who is eligible. The limit on possession has not been determined, either, but the language of the law calls for a “60 day supply for personal medical use.” It has yet to be seen how this will be regulated, but my guess is that Massachusetts will adopt a system similar to other states with medicinal marijuana laws already in place. Clearly, there are many details that need to be sorted out. But Massachusetts is certainly off to a good start.
